Datenschutzerklärung

Der Schutz eurer persönlichen Daten ist mir wichtig. Ich verarbeite eure Daten ausschließlich auf Grundlage der gesetzlichen Bestimmungen (DSGVO, DSG, TKG 2021). In dieser Erklärung informiere ich euch über die wichtigsten Aspekte der Datenverarbeitung auf dieser Website.

2. Hosting und Server-Logfiles

Diese Website wird bei [ЗАПОВНИТИ: Name und Anschrift des Hosting-Anbieters] gehostet. Beim Aufruf der Website erfasst der Server automatisch Informationen in sogenannten Logfiles: IP-Adresse, Datum und Uhrzeit des Zugriffs, aufgerufene Seite bzw. Datei, übertragene Datenmenge, Browsertyp und -version, Betriebssystem sowie die zuvor besuchte Seite (Referrer).

Diese Daten werden nicht mit anderen Datenquellen zusammengeführt. Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einem sicheren und stabilen Betrieb der Website). Logfiles werden nach [ЗАПОВНИТИ: Speicherdauer laut Hoster, z. B. 14 Tagen] gelöscht.

3. Kontaktformular (FormSubmit)

Wenn ihr mir über das Anfrageformular schreibt, werden die eingegebenen Daten (Name, E-Mail-Adresse, Hochzeitsdatum, Ort, gewünschtes Paket, Nachricht, die gewählte Sprache (DE/EN), eure IP-Adresse sowie der Zeitpunkt der Anfrage) zur Bearbeitung der Anfrage und für Anschlussfragen bei mir gespeichert. Die Angabe von Name und E-Mail-Adresse ist für die Beantwortung erforderlich, alle weiteren Angaben sind freiwillig.

Für die Übermittlung der Formulardaten nutze ich den Dienst FormSubmit (formsubmit.co). Die eingegebenen Daten werden dabei an die Server von FormSubmit übertragen und von dort per E-Mail an mich weitergeleitet. FormSubmit verarbeitet dabei auch eure IP-Adresse und technische Browserdaten. Die Server von FormSubmit können sich in den USA befinden; ein Angemessenheitsbeschluss nach dem EU-US Data Privacy Framework liegt für FormSubmit [ЗАПОВНИТИ: Status unter dataprivacyframework.gov prüfen – „vor“ oder „nicht vor“]. Soweit kein Angemessenheitsbeschluss greift, erfolgt die Übermittlung auf Grundlage eurer ausdrücklichen Einwilligung nach Art. 49 Abs. 1 lit. a DSGVO, die ihr durch Aktivieren des Kontrollkästchens im Formular erteilt. Bitte beachtet, dass in den USA kein dem EU-Recht gleichwertiges Datenschutzniveau garantiert ist und Behörden dort unter Umständen auf Daten zugreifen können. Wenn ihr das nicht möchtet, erreicht ihr mich jederzeit auch per E-Mail oder Telefon. Weitere Informationen findet ihr in der Datenschutzerklärung von FormSubmit: formsubmit.co/privacy.pdf (PDF).

Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO (Durchführung vorvertraglicher Maßnahmen auf Anfrage) sowie Art. 6 Abs. 1 lit. a DSGVO (Einwilligung, die ihr durch das Absenden des Formulars erteilt). Die Einwilligung kann jederzeit mit Wirkung für die Zukunft per E-Mail widerrufen werden. Eure Anfragedaten speichere ich, bis die Anfrage abschließend bearbeitet ist bzw. – bei Buchung – bis zum Ablauf gesetzlicher Aufbewahrungspflichten (in der Regel 7 Jahre nach § 132 BAO).

4. Kontakt per E-Mail, Telefon und WhatsApp

Wenn ihr mich per E-Mail, Telefon oder WhatsApp kontaktiert, werden eure Angaben zur Bearbeitung der Anfrage und für Anschlussfragen gespeichert (Art. 6 Abs. 1 lit. b und f DSGVO).

E-Mail-Postfach: Für den E-Mail-Verkehr – auch für die über das Formular weitergeleiteten Anfragen – nutze ich Gmail von Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland. Dabei können Daten an Google LLC in die USA übermittelt werden; Google LLC ist nach dem EU-US Data Privacy Framework zertifiziert [ЗАПОВНИТИ: Status prüfen]. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einer zuverlässigen Kommunikation).

Auf dieser Website befindet sich ein Link zu WhatsApp (Betreiber: WhatsApp Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland, Teil von Meta Platforms). Erst wenn ihr den Link anklickt, wird WhatsApp geöffnet; dabei gelten die Datenschutzbestimmungen von WhatsApp: whatsapp.com/legal/privacy-policy-eea. Durch das bloße Aufrufen dieser Website werden keine Daten an WhatsApp übertragen.

Wenn ihr mir über WhatsApp schreibt, verarbeitet WhatsApp eure Telefonnummer, euren Profilnamen, Nachrichteninhalte (Ende-zu-Ende-verschlüsselt) sowie Metadaten wie den Zeitpunkt der Nachricht; dabei können Daten an Meta Platforms Inc. in den USA übermittelt werden. Die Übermittlung stützt sich auf die EU-Standardvertragsklauseln bzw. – soweit zertifiziert – auf das EU-US Data Privacy Framework. Eure Nachrichten speichere ich auf meinem Gerät zur Bearbeitung der Anfrage (Art. 6 Abs. 1 lit. b und f DSGVO) und lösche sie, sobald die Anfrage erledigt ist bzw. gesetzliche Aufbewahrungsfristen abgelaufen sind. [ЗАПОВНИТИ: nur stehen lassen, wenn es stimmt: „Ich nutze WhatsApp Business und synchronisiere keine Kontakte mit WhatsApp.“] Wenn ihr WhatsApp nicht nutzen möchtet, schreibt mir einfach per E-Mail.

5. Instagram

Diese Website enthält lediglich einen Link zu meinem Instagram-Profil. Es sind keine Social-Media-Plugins eingebunden; beim Aufrufen dieser Website werden keine Daten an Instagram bzw. Meta übertragen. Erst beim Anklicken des Links gelten die Datenschutzbestimmungen von Instagram.

6. Schriftarten, Videos und Audio

Die verwendeten Schriftarten (Cormorant Garamond, Jost) sowie alle Videos, Fotos und Tonaufnahmen werden lokal von meinem Webserver geladen. Es werden keine Google Fonts, keine externen Video-Plattformen und keine Content-Delivery-Netzwerke eingebunden. Beim bloßen Aufrufen der Website werden daher – abgesehen vom Hosting-Anbieter (Punkt 2) – keine Daten an Google oder andere Drittanbieter übertragen.

7. Cookies und lokale Speicherung

Diese Website verwendet keine Cookies und keine Tracking- oder Analyse-Tools. Nur wenn ihr aktiv über den DE/EN-Schalter eine Sprache wählt, wird diese Auswahl (Wert „de“ oder „en“) im lokalen Speicher eures Browsers (localStorage) abgelegt, damit die Website beim nächsten Besuch in der gewählten Sprache angezeigt wird – ohne zeitliche Befristung, bis ihr sie über die Browsereinstellungen löscht. Der Wert enthält keine personenbezogenen Daten; die Speicherung ist für diese von euch ausdrücklich gewünschte Einstellung erforderlich (§ 165 Abs. 3 TKG 2021).

8. Weitergabe von Daten

Eine Weitergabe eurer Daten an Dritte erfolgt nur, soweit dies zur Bearbeitung eurer Anfrage oder zur Erfüllung eines Vertrags erforderlich ist (z. B. an den Formulardienst FormSubmit, siehe Punkt 3, und an meinen E-Mail-Anbieter Google, siehe Punkt 4) oder ich gesetzlich dazu verpflichtet bin.

9. Eure Rechte

Euch stehen grundsätzlich die Rechte auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18), Datenübertragbarkeit (Art. 20) und Widerspruch (Art. 21) zu. Eine erteilte Einwilligung könnt ihr jederzeit widerrufen.

Widerspruchsrecht: Soweit ich eure Daten auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO verarbeite, könnt ihr aus Gründen, die sich aus eurer besonderen Situation ergeben, jederzeit Widerspruch einlegen (Art. 21 DSGVO) – formlos an vitocello.booking@gmail.com.

Wenn ihr glaubt, dass die Verarbeitung eurer Daten gegen das Datenschutzrecht verstößt oder eure Ansprüche sonst in einer Weise verletzt worden sind, könnt ihr euch bei der Aufsichtsbehörde beschweren. In Österreich ist dies die Datenschutzbehörde, Barichgasse 40–42, 1030 Wien, Telefon +43 1 52 152-0, E-Mail dsb@dsb.gv.at, www.dsb.gv.at.

10. Sicherheit

Diese Website ist über HTTPS (SSL/TLS) verschlüsselt. Ich treffe angemessene technische und organisatorische Maßnahmen, um eure Daten vor Verlust, Missbrauch und unbefugtem Zugriff zu schützen.

11. Änderungen

Ich behalte mir vor, diese Datenschutzerklärung anzupassen, wenn sich die Rechtslage oder die technische Ausgestaltung der Website ändert. Es gilt jeweils die hier veröffentlichte Fassung.

2. Hosting and server log files

This website is hosted by [ЗАПОВНИТИ: name and address of the hosting provider]. When you visit the website, the server automatically records information in log files: IP address, date and time of access, page or file requested, amount of data transferred, browser type and version, operating system and the referring page.

This data is not merged with other data sources. Processing is based on Art. 6(1)(f) GDPR (legitimate interest in a secure and stable operation of the website). Log files are deleted after [ЗАПОВНИТИ: retention period according to the host, e.g. 14 days].

3. Contact form (FormSubmit)

If you write to me via the enquiry form, the data you enter (name, e-mail address, wedding date, venue, requested package, message, the chosen language (DE/EN), your IP address and the time of the enquiry) is stored by me in order to process your enquiry and for follow-up questions. Name and e-mail address are required for a reply; all other details are voluntary.

To transmit the form data I use the service FormSubmit (formsubmit.co). The data entered is transferred to FormSubmit's servers and forwarded to me by e-mail. FormSubmit also processes your IP address and technical browser data. FormSubmit's servers may be located in the USA; an adequacy decision under the EU-US Data Privacy Framework [ЗАПОВНИТИ: check status at dataprivacyframework.gov – "applies" / "does not apply"] to FormSubmit. Where no adequacy decision applies, the transfer is based on your explicit consent under Art. 49(1)(a) GDPR, which you give by ticking the checkbox in the form. Please note that the USA does not guarantee a level of data protection equivalent to EU law and that authorities there may be able to access data. If you prefer not to, you can always reach me by e-mail or phone instead. Further information can be found in FormSubmit's privacy policy: formsubmit.co/privacy.pdf (PDF).

The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures at your request) and Art. 6(1)(a) GDPR (consent given by submitting the form). You may withdraw your consent at any time with effect for the future by e-mail. I store your enquiry data until your enquiry has been fully processed or – in the case of a booking – until statutory retention periods expire (generally 7 years under § 132 Austrian Federal Fiscal Code).

4. Contact by e-mail, phone and WhatsApp

If you contact me by e-mail, phone or WhatsApp, your details are stored in order to process the enquiry and for follow-up questions (Art. 6(1)(b) and (f) GDPR).

E-mail account: For e-mail correspondence – including enquiries forwarded from the form – I use Gmail by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Data may be transferred to Google LLC in the USA; Google LLC is certified under the EU-US Data Privacy Framework [ЗАПОВНИТИ: check status]. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in reliable communication).

This website contains a link to WhatsApp (operated by WhatsApp Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, part of Meta Platforms). WhatsApp only opens once you click the link; WhatsApp's privacy policy then applies: whatsapp.com/legal/privacy-policy-eea. Merely visiting this website does not transfer any data to WhatsApp.

If you write to me via WhatsApp, WhatsApp processes your phone number, your profile name, message content (end-to-end encrypted) and metadata such as the time of the message; data may be transferred to Meta Platforms Inc. in the USA. The transfer is based on the EU standard contractual clauses or – where certified – on the EU-US Data Privacy Framework. I store your messages on my device to process the enquiry (Art. 6(1)(b) and (f) GDPR) and delete them once the enquiry is settled or statutory retention periods have expired. [ЗАПОВНИТИ: keep only if true: "I use WhatsApp Business and do not sync contacts with WhatsApp."] If you prefer not to use WhatsApp, simply write to me by e-mail.

5. Instagram

This website only contains a link to my Instagram profile. No social media plugins are embedded; visiting this website does not transfer any data to Instagram or Meta. Instagram's privacy policy applies only once you click the link.

6. Fonts, videos and audio

The fonts used (Cormorant Garamond, Jost) as well as all videos, photos and audio recordings are served locally from my web server. No Google Fonts, external video platforms or content delivery networks are embedded. Merely visiting the website therefore does not transfer any data to Google or other third parties, apart from the hosting provider (section 2).

7. Cookies and local storage

This website does not use cookies or any tracking or analytics tools. Only if you actively choose a language via the DE/EN switch is that choice (value "de" or "en") saved in your browser's local storage so that the website is displayed in the chosen language on your next visit – without a time limit, until you delete it via your browser settings. The value contains no personal data; the storage is necessary for this setting you explicitly requested (§ 165(3) TKG 2021).

8. Disclosure of data

Your data is only passed on to third parties where this is necessary to process your enquiry or to perform a contract (e.g. to the form service FormSubmit, see section 3, and to my e-mail provider Google, see section 4) or where I am legally obliged to do so.

9. Your rights

You have the rights of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21). You may withdraw any consent given at any time.

Right to object: Where I process your data on the basis of Art. 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation (Art. 21 GDPR) – informally by e-mail to vitocello.booking@gmail.com.

If you believe that the processing of your data violates data protection law or that your rights have otherwise been infringed, you can lodge a complaint with the supervisory authority. In Austria this is the Datenschutzbehörde, Barichgasse 40–42, 1030 Vienna, phone +43 1 52 152-0, e-mail dsb@dsb.gv.at, www.dsb.gv.at.

10. Security

This website is encrypted via HTTPS (SSL/TLS). I take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access.

11. Changes

I reserve the right to amend this privacy policy if the legal situation or the technical design of the website changes. The version published here applies.
